2019. évi LXXXVIII. törvény

a Magyarország Kormánya és a Bahreini Királyság Kormánya között a diplomata-, szolgálati és különleges útlevéllel rendelkező állampolgáraik vízummentességéről szóló Megállapodás kihirdetéséről

1. § Az Országgyűlés e törvénnyel felhatalmazást ad a Magyarország Kormánya és a Bahreini Királyság Kormánya között a diplomata-, szolgálati és különleges útlevéllel rendelkező állampolgáraik vízummentességéről szóló Megállapodás (a továbbiakban: Megállapodás) kötelező hatályának elismerésére.

2. § Az Országgyűlés a Megállapodást e törvénnyel kihirdeti.

3. § (1) A Megállapodás hiteles magyar nyelvű szövegét az 1. melléklet tartalmazza.

(2) A Megállapodás hiteles angol nyelvű szövegét a 2. melléklet tartalmazza.

4. § (1) Ez a törvény – a (2) bekezdésben meghatározott kivétellel – a kihirdetését követő napon lép hatályba.

(2) A 2. § és a 3. §, az 1. melléklet és a 2. melléklet a Megállapodás 11. cikk (1) bekezdésében meghatározott időpontban lép hatályba.

(3) A Megállapodás, illetve a 2. § és a 3. §, az 1. melléklet és a 2. melléklet hatálybalépésének naptári napját a külpolitikáért felelős miniszter annak ismertté válását követően a Magyar Közlönyben haladéktalanul közzétett közleményével állapítja meg.

5. § E törvény végrehajtásához szükséges intézkedésekről a külpolitikáért felelős miniszter gondoskodik.

MEGÁLLAPODÁS MAGYARORSZÁG KORMÁNYA ÉS A BAHREINI KIRÁLYSÁG KORMÁNYA KÖZÖTT A DIPLOMATA-, SZOLGÁLATI ÉS KÜLÖNLEGES ÚTLEVÉLLEL RENDELKEZŐ ÁLLAMPOLGÁRAIK VÍZUMMENTESSÉGÉRŐL

Magyarország Kormánya és a Bahreini Királyság Kormánya (a továbbiakban: „Fél” illetve „Felek”),

attól a szándéktól vezérelve, hogy elősegítsék a két ország közötti baráti kapcsolatok és együttműködés további fejlődését,

azzal a szándékkal, hogy elősegítsék az érvényes diplomata-, szolgálati és különleges útlevéllel rendelkező állampolgáraiknak az országaik területére történő belépését,

az alábbiakban állapodnak meg:

AGREEMENT BETWEEN THE GOVERNMENT OF HUNGARY AND THE GOVERNMENT OF THE KINGDOM OF BAHRAIN ON THE EXEMPTION OF VISA REQUIREMENTS FOR HOLDERS OF DIPLOMATIC, SERVICE AND SPECIAL PASSPORTS

The Government of Hungary and the Government of the Kingdom of Bahrain, hereinafter referred to as “Party” or “the Parties”,

Desiring to promote the further development of friendly relations and cooperation between the two countries,

Wishing to facilitate the entry of their nationals holding valid diplomatic, service and special passports into the territory of their respective countries,

Have agreed as follows:

Article 1

Provisions of the Agreement shall apply to valid diplomatic, foreign service and service (together: service) passports for Hungary, and valid diplomatic and special passports for the Kingdom of Bahrain.

Article 2

Nationals of both Parties who are in possession of passports referred to in Article 1, may enter into, exit from, transit through the territory of the other Party without a visa and stay there without a residence permit for a period not exceeding ninety (90) days in any 180-day period, which entails considering the 180-day period preceding each day of stay.

Article 3

(1) Nationals of the state of one Party, holding passports referred to in Article 1, who are members of the diplomatic or consular missions accredited to the other Party, as well as their family members forming part of their household shall be required to obtain an appropriate entry visa prior to their entry.

(2) The Parties shall notify each other of the arrival of their above mentioned nationals through diplomatic channels.

Article 4

(1) Nationals of each Party referred to in Articles 2 and 3, may enter the territory of the other Party via border crossing points designated for international traffic.

(2) Nationals referred to in Articles 2 and 3 shall be in possession of a passport valid for at least six (6) months from the date of entry into the territory of the other Party.

Article 5

(1) The Parties shall exchange personalized specimens of the passports referred to in Article 1 through diplomatic channels within thirty (30) days after the entry into force of the Agreement.

(2) In case one of the Parties introduces a new diplomatic, service or special passport, the personalized specimens of the said passport shall be transmitted to the other Party through diplomatic channels at least thirty (30) days prior to the date of their introduction.

Article 6

Provisions of the Agreement shall not exempt nationals of the state of one Party holding valid diplomatic, service or special passports from the obligation to respect the laws and regulations in force related to the entry, sojourn, employment and gainful activities of foreign nationals in the territory of the state of the other Party throughout the duration of their stay.

Article 7

(1) The Agreement shall not affect the right of the Parties to deny the permit to enter, stay in, or transit through their respective territories to those persons whose presence in the territory of their state they consider undesirable.

(2) Both Parties reserve the right to deny entry, transit and stay to nationals of the state of the other Party for reasons of public order, public security or public health.

(3) The implementation of the Agreement may be temporarily suspended, partly or entirely, by either Party for reasons of public order, public security or public health. The other Party shall be notified through diplomatic channels within three (3) days about the suspension and about the termination thereof.

Article 8

In case of loss or damage of a diplomatic, service or special passport in the territory of the other Party, the national affected shall immediately notify the competent authorities of the receiving state through the diplomatic or consular mission of the state of his nationality. The diplomatic or consular mission concerned shall issue a travel document enabling the aforementioned person to return home, and shall notify the competent authorities of the receiving state accordingly.

Article 9

This Agreement shall be implemented in line with the laws and regulations in force in both countries. Cooperation under this Agreement does not affect the rights and obligations of the parties arising from the international conventions to which they are parties to. The Agreement shall in no way prejudice the obligations of Hungary deriving from its membership in the European Union.

Article 10

Any dispute arising between the Parties in relation to the interpretation or implementation of the Agreement shall be settled amicably by direct consultations and through diplomatic channels between the Parties without reference to any third party or an international tribunal.

Article 11

(1) The Agreement is concluded for an indefinite period of time. It shall enter into force on the thirtieth (30.) day after receiving the last written notification through diplomatic channels by which the Parties have confirmed that their respective internal procedures required for the entry into force of the Agreement have been completed.

(2) The Agreement may be amended only by mutual written consent of the Parties. Such amendment or revision shall enter into force according to the provisions of Paragraph (1), and form an integral part of this Agreement.

(3) Either Party may, at any time, denounce the Agreement by a notification addressed to the other Party in written form through diplomatic channels. The Agreement shall terminate ninety (90) days after the date of receiving the notification of denunciation.

Done at New York, on 27th September, 2019 in two original copies, in Hungarian, Arabic and English languages, all texts being equally authentic. In case of any divergence in interpretation of the provisions of the Agreement, the English version shall prevail.
